End User License Agreement

EFFECTIVE AND LAST UPDATED: JULY 15, 2026

This End User License Agreement (“EULA”) is a binding agreement between you and Cumulonimbus LLC, which owns and operates ColorfulVibe (“Cumulonimbus,” “we,” or “us”), for the ColorfulVibe desktop application and its bundled documentation (“Software”). Installing, copying, or using the Software means you accept this EULA. If you do not agree, do not install or use it and request any available refund under the Refund and Cancellation Policy.

1. Commercial license grant

Subject to payment, the applicable order, and compliance with this EULA, Cumulonimbus LLC grants the licensed user a limited, non-exclusive, non-sublicensable, non-transferable, revocable license to install and run the Software on the number of devices allowed by the license. You may use it for personal or internal business development work on systems you own or are authorized to administer. You may make one reasonable archival backup copy that remains subject to this EULA.

2. Named users and organizations

A personal license is for one natural person. An organization may buy licenses for its personnel, but each entitlement is limited to its assigned user unless the order expressly provides a concurrent, team, or site license. Reassignment must be legitimate and must not be used to evade user or device limits.

The Software requires a valid key and periodic contact with the ColorfulVibe license service. Activation transmits the key, a one-way device identifier, and app version. The service returns a signed, device-bound certificate that permits offline use until its expiration. The Software may stop protected functionality if a certificate expires, a license is revoked or expires, a device is deactivated, or a device limit is reached. The Privacy Policy describes the associated processing.

5. Ownership

The Software is licensed, not sold. Cumulonimbus LLC and its licensors retain all title, copyright, trade-secret, trademark, and other intellectual property rights. This EULA grants only the express use rights above. It does not transfer ownership of the Software, source code, branding, or technical protections.

6. Third-party and open-source components

The Software may include third-party components governed by separate notices or open-source licenses. Those licenses control only the relevant components and may grant additional rights. This EULA does not restrict a right granted directly under an applicable open-source license. ColorfulVibe does not bundle Claude Code, OpenAI Codex, or other agent subscriptions; those tools are separately installed and licensed.

7. Your data and local operation

You retain ownership of your projects, terminal content, prompts, and other materials. The Software primarily processes them locally and does not grant Cumulonimbus LLC a license to use them. You are responsible for backups and authorization to access files, repositories, devices, and remote systems. Vault values remain subject to your security practices and any Secured Run configuration you authorize.

8. Third-party tools and output

The Software launches or coordinates tools and commands chosen by you. Cumulonimbus LLC does not control third-party models, output, accounts, pricing, or uptime and is not responsible for a command or generated action merely because the Software displayed or executed it at your direction. Review consequential actions and maintain recoverable backups.

9. Updates and compatibility

Updates may add, modify, or remove features and may be required for security, compatibility, or continued license-service access. Unless an update has separate terms, it is part of the Software under this EULA. Supported operating systems, architecture, dependencies, and technical protection measures will be disclosed with the product or order.

10. Support

Support, maintenance, and update commitments are limited to those stated in the applicable order. Activation assistance is available at support@colorfulvibe.com. Do not send a full license key, vault secret, project source, or sensitive terminal transcript unless specifically necessary and requested through a secure method.

11. Term and termination

This EULA begins when you first install or use the Software and continues for the license term. It terminates automatically when the entitlement expires or if you materially breach the EULA and fail to cure after notice where cure is appropriate. Fraud, deliberate circumvention, malicious activity, or unlawful distribution may result in immediate termination. On termination, stop using and delete all copies. Ownership, restrictions, disclaimers, liability limits, and provisions intended by nature to survive will survive.

12. Export and sanctions

You must comply with applicable export-control, import, and sanctions laws. You represent that you are not prohibited from receiving the Software and will not export, re-export, or use it for a prohibited end use, destination, or person.

13. Warranty disclaimer

To the maximum extent permitted by law, the Software is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, or uninterrupted or error-free operation. Cumulonimbus LLC does not warrant third-party agents, generated output, or commands you choose to run. Nothing here excludes a warranty or conformity right that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Cumulonimbus LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profit, revenue, goodwill, data, or business interruption. Aggregate liability for the Software will not exceed the greater of the amount paid for the affected license during the preceding 12 months or USD $100. These limits do not apply where liability cannot legally be limited.

15. Consumers and general terms

Non-waivable consumer rights control over conflicting language. If part of this EULA is unenforceable, it will be limited to the minimum extent necessary and the remainder continues. Delay in enforcement is not a waiver. You may not assign this EULA without written consent except where law requires transferability. The EULA, applicable order, and incorporated online terms are the entire software-license agreement.
